TERMS & CONDITIONS
Aveni Cherie | The Galactic Alchemist
These Terms & Conditions (“Terms”) govern your access to and use of the website, services, programs, memberships, mentorships, events, courses, digital products, resources and other offerings provided under the brands Aveni Cherie and The Galactic Alchemist.
The relevant contracting entity for an offering will be identified at the point of purchase, booking, enrolment or registration and may be Aveni Cherie as a sole trader 13 944 793 280 or Anahata Divine Essentials Pty Ltd 38 614 478 545, trading as or operating under Aveni Cherie and/or The Galactic Alchemist (“we”, “us”, “our”).
By accessing our website, purchasing a product, booking a service, enrolling in a program, attending an event, joining a membership or otherwise engaging with our offerings, you agree to these Terms.
If you do not agree with these Terms, please do not purchase, enrol, book or use the relevant offering.
1. OUR SERVICES & OFFERINGS
Our offerings may include, but are not limited to:
Luminous Heart Squad membership and community experiences;
VIP 1:1 mentorships, including Violet Ray, Golden Ray and Diamond Ray pathways;
individual healing, mentoring, clarity and BodySoul Alchemy sessions where offered;
Arcturian Quantum Healing and other energetic or spiritual sessions;
Master Your Light and other group journeys;
Phoenix Recode, Phoenix Alchemy and related programs;
practitioner education and training programs;
Inner Circle and graduate experiences;
Chamber of Light Healing Circles;
online and in-person workshops, retreats, immersions, ceremonies, circles and events;
meditations, activations, transmissions and energetic practices;
Cosmic Codes, Cosmic Pulse and other teachings or resources;
workbooks, PDFs, recordings, videos, audio resources and downloadable materials;
courses, memberships, subscriptions and online communities;
spiritual, energetic, consciousness, personal development and transformational mentoring;
and any other physical, digital or service-based offerings made available by us.
Specific offerings may have additional terms, participation requirements, payment arrangements or agreements. Where additional written terms apply to a particular offering, those terms should be read together with these Terms.
2. NATURE OF OUR WORK
Our work incorporates spiritual, energetic, metaphysical, educational, personal development and transformational frameworks.
Depending upon the offering, this may include concepts and practices relating to energy healing, chakra consciousness, meditation, visualisation, embodiment, consciousness, spiritual development, intuitive exploration, energetic practices and other proprietary or spiritually oriented methodologies.
You acknowledge that experiences of spiritual, energetic and personal development work are subjective and vary between individuals.
We do not guarantee any particular spiritual, energetic, emotional, personal, professional, financial, relationship, health or other outcome as a result of participating in our services or using our products.
3. HEALTH & WELLBEING DISCLAIMER
Unless expressly stated otherwise in relation to a suitably qualified professional service, our offerings are provided for educational, spiritual, personal development and wellbeing purposes.
They are not intended to diagnose, treat, cure or prevent any medical or psychological condition and are not a substitute for medical, psychological, psychiatric or other appropriately qualified healthcare advice, diagnosis or treatment.
You remain responsible for decisions concerning your physical and mental health and wellbeing.
If you have concerns about your health, are experiencing symptoms, have an existing health condition, are taking medication, or are receiving treatment, you should seek advice from an appropriately qualified healthcare professional where relevant before participating in practices that may affect your wellbeing.
You should not discontinue or alter prescribed medication, medical treatment or professional healthcare based solely upon information provided through our services.
If you experience a medical or mental health emergency, contact the appropriate emergency or healthcare service.
4. PERSONAL RESPONSIBILITY
Participation in our offerings is voluntary.
By participating, you acknowledge that personal development, spiritual exploration, mentoring and energetic practices may involve self-reflection and may bring awareness to emotions, beliefs, memories, behaviours or personal experiences.
You are responsible for determining whether an offering is appropriate for you and for communicating any relevant concerns or limitations where necessary.
You retain responsibility for your own choices, actions, decisions, wellbeing, business, finances, relationships and life circumstances.
Our role is to provide the relevant service, education, mentoring, facilitation, resources or experience. We do not make decisions on your behalf.
5. LUMINOUS HEART SQUAD
Luminous Heart Squad is a membership and community space designed to provide teachings, practices, resources, community experiences and other content.
Membership inclusions may change or evolve over time.
Depending on the current membership structure, members may receive access to resources such as community content, Cosmic Codes materials, PDFs, teachings, healing circles, transmissions, recordings, discussions and other membership experiences.
Any free access or introductory period, including a promotional 60-day free access period where offered, is subject to the specific conditions displayed at the time of registration.
Membership content is for the registered member's personal use only and may not be copied, distributed, taught, sold, shared or made available to non-members without written permission.
Members must communicate respectfully and protect the privacy and confidentiality of other community members.
We reserve the right to moderate content and, where reasonably necessary, restrict or remove access for conduct that breaches these Terms, community guidelines or the safety and integrity of the community.
6. VIP 1:1 MENTORSHIPS
Our VIP mentorship pathways may include programs such as Violet Ray, Golden Ray and Diamond Ray mentorships.
Each mentorship may have its own duration, inclusions, session frequency, resources, support arrangements, investment and payment schedule.
Mentorship may include a combination of sessions, teachings, practices, energetic work, resources, workbooks, activations, community access and between-session support, depending on the specific program purchased.
Participation does not guarantee a particular personal, spiritual, business, financial or other result.
The client remains responsible for completing practices, attending sessions and integrating the work in a manner appropriate to them.
Additional mentorship agreements may be required for particular programs
7. GROUP JOURNEYS, COURSES & TRAINING
Group programs may include Master Your Light, Phoenix Recode, Phoenix Alchemy, practitioner training, Inner Circle experiences and other journeys offered from time to time.
Programs may be delivered live, online, in person, through recordings, or through a combination of formats.
Program structure, modules, schedules, guest contributors and delivery methods may occasionally be adjusted where reasonably necessary to maintain or improve the offering.
Access to practitioner training, certification or advanced programs may be subject to prerequisites.
Completion of a training program does not guarantee professional registration, employment, income, business success or recognition by a third-party professional or regulatory body unless expressly stated.
8. EVENTS, RETREATS, CIRCLES & LIVE EXPERIENCES
We may offer in-person and online events, retreats, workshops, immersions, ceremonies, healing circles and other live experiences.
Participants are responsible for assessing their ability to participate and complying with reasonable event instructions.
For in-person events, participants are responsible for their own travel, accommodation and associated expenses unless expressly included in the event purchase.
Event dates, locations, facilitators or schedules may occasionally need to change due to circumstances outside our reasonable control. Where this occurs, we will communicate material changes and provide remedies where required by applicable law.
Additional event-specific conditions may apply and will be communicated where relevant.
9. BOOKINGS & APPOINTMENTS
Appointments must be booked through the designated booking process.
Please attend scheduled sessions at the agreed time.
Cancellation, rescheduling and missed-session conditions may vary depending on the service or program and will be communicated through the booking page, program agreement or other applicable terms.
Where a client arrives late, the session may still need to finish at the scheduled time.
Nothing in our cancellation or rescheduling policies excludes rights or remedies that cannot lawfully be excluded under applicable consumer law.
10. PURCHASES & PAYMENTS
Prices are displayed at the point of purchase or communicated before enrolment.
Payments may be made in full or through an approved payment plan where available.
By selecting a payment plan, you agree to make all payments according to the payment schedule presented to you or contained in your program agreement.
Where recurring payments are authorised, you authorise the relevant payment processor to charge the nominated payment method according to the disclosed payment schedule until the applicable purchase obligation or subscription is completed or cancelled in accordance with its terms.
If a payment fails, access to the applicable service, program, membership or materials may be temporarily suspended while the payment issue is resolved, subject to applicable law and the terms of the purchase.
11. REFUNDS, CANCELLATIONS & CONSUMER RIGHTS
Refund and cancellation conditions may differ depending upon whether you purchase a membership, digital product, event, course, mentorship or other service.
Any specific refund or cancellation terms disclosed before purchase form part of your agreement with us.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
Where you are entitled to a remedy under applicable consumer law, these Terms do not limit that entitlement.
Change-of-mind refunds may not be available for certain products or services except where expressly offered or required by law.
12. DIGITAL PRODUCTS & CONTENT ACCESS
Digital products may include PDFs, workbooks, audio files, videos, meditations, activations, transmissions, recordings, courses, templates and other digital resources.
Unless otherwise stated, purchasing a digital product gives you a limited, personal, non-exclusive and non-transferable right to use the material for your own personal purposes.
Purchase does not transfer ownership of the intellectual property.
You must not reproduce, redistribute, resell, publish, upload, share, teach from, commercially exploit or create substantially derivative materials from our protected content without prior written permission, except to the extent permitted by law.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, content created and provided by us remains our intellectual property or is used by us under appropriate licence.
This may include, without limitation:
written teachings and educational materials;
Chakra Consciousness frameworks;
proprietary healing, mentoring and transformational modalities;
BodySoul Alchemy materials;
program structures and methodologies;
Cosmic Codes and Cosmic Pulse content;
meditations and activations;
energetic and spiritual frameworks;
diagrams, graphics, symbols and designs;
workbooks and PDFs;
videos and audio recordings;
event and workshop materials;
course and training content;
branding, logos and original visual assets;
and other original materials created for our programs and services.
No purchase or participation grants ownership of our intellectual property unless expressly agreed in writing.
You may not represent our original work as your own or use protected materials to create, teach or sell a substantially reproduced version of our programs, modalities or resources without written authorisation.
Any practitioner licensing, certification or permission to use particular methodologies professionally will be governed by the specific written terms of the relevant training or licence.
14. RECORDINGS & ONLINE SESSIONS
Some group calls, workshops, classes, healing circles or events may be recorded.
Where a session is intended to be recorded, participants will be informed as appropriate.
Recordings may be made available to participants or members.
Participants must not independently record private sessions, group calls, events or program content without permission.
Where participant names, voices, images or contributions may be identifiable in recordings intended for broader promotional or commercial use, appropriate consent will be obtained where required.
15. CONFIDENTIALITY & COMMUNITY PRIVACY
We recognise that clients and community members may share personal experiences during mentorships, sessions, groups, circles and events.
Participants must respect the confidentiality and privacy of other participants.
You must not share another participant's personal story, identifying information, screenshots, recordings or private communications outside the relevant space without their permission.
We will handle personal information in accordance with our Privacy Policy and applicable privacy obligations.
16. TESTIMONIALS
Testimonials and participant stories represent individual experiences.
They do not guarantee that another person will experience the same or similar results.
We will obtain appropriate permission before using identifiable client testimonials, images or stories for promotional purposes where required.
17. COMMUNITY CONDUCT
We aim to provide respectful spaces for learning, transformation, spiritual exploration and community connection.
Harassment, bullying, discrimination, threats, abusive behaviour, deliberate disruption, unauthorised solicitation, infringement of intellectual property or breaches of another participant's privacy are not permitted.
We may take reasonable action to protect participants and our community, including moderating content, issuing warnings or removing access where necessary.
Removal from a community or program does not automatically create a right to a refund. Any refund entitlement will be determined by the applicable purchase terms and consumer law.
18. THIRD-PARTY SERVICES & LINKS
Our website, programs or communities may contain links to or integrate with third-party platforms, payment processors, applications, video platforms, social media platforms or other services.
We do not control third-party services and are not responsible for their independent terms, privacy practices, availability or content.
Your use of third-party services may be subject to their own terms and policies.
19. WEBSITE USE
You agree to use our website and digital platforms lawfully and respectfully.
You must not knowingly:
interfere with website functionality or security;
attempt unauthorised access to accounts or systems;
distribute malicious software;
scrape, reproduce or extract protected content without permission;
impersonate another person;
or use our platforms for unlawful activity.
We may restrict access where reasonably necessary to protect our website, intellectual property, users or business.
20. NO GUARANTEE OF RESULTS
Personal development, spiritual growth, healing experiences, business development and other outcomes depend upon many individual factors.
Testimonials, examples, case studies and descriptions of previous experiences are illustrative only.
We do not guarantee particular outcomes, including spiritual experiences, healing outcomes, financial results, income, manifestation outcomes, business growth or other specific changes.
21. PROFESSIONAL & FINANCIAL DECISIONS
Information provided through our programs is not legal, accounting, taxation, financial or investment advice.
Where decisions require specialist professional advice, you should consult an appropriately qualified professional.
You remain responsible for decisions made in relation to your business, finances, legal affairs and personal circumstances.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of our website, products or services.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
Where liability may lawfully be limited, it will be limited only to the extent permitted by applicable law.
23. INDEMNITY
To the extent permitted by law, you agree to indemnify us against losses, liabilities, claims or expenses arising from your unlawful use of our website or materials, your infringement of another person's rights, or your material breach of these Terms.
This clause does not apply to the extent that loss was caused by our negligence, breach of law or other conduct for which liability cannot lawfully be excluded.
24. SUSPENSION OR TERMINATION
We may suspend or terminate access to an offering where reasonably necessary due to serious or repeated breach of these Terms, non-payment, unlawful conduct, infringement of intellectual property, or behaviour that materially compromises the safety or integrity of a program or community.
Where possible and appropriate, concerns may first be addressed directly with the participant.
Any financial consequences of termination will be determined according to the applicable agreement, these Terms and consumer law.
25. CHANGES TO SERVICES
Our work and offerings may evolve.
We may update program structures, resources, platforms, schedules or inclusions where reasonably necessary.
We will not make changes that materially reduce a paid offering without considering participants' contractual and consumer rights.
26. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our services, business practices or legal obligations.
The current version will be published with its “Last Updated” date.
Changes will apply prospectively unless otherwise permitted by law.
27. PRIVACY
Our collection, storage and handling of personal information is governed by our Privacy Policy and applicable Australian privacy law.
Please review the Privacy Policy before providing personal information through our website, programs or services.
28. GOVERNING LAW
These Terms are governed by the laws applicable in New South Wales, Australia, and the Commonwealth laws of Australia that apply.
Subject to any rights you have to bring proceedings elsewhere under applicable law, the parties submit to the jurisdiction of the courts of New South Wales and applicable Commonwealth courts.
29. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue to operate.
30. ENTIRE AGREEMENT
These Terms, together with any applicable booking terms, program agreement, payment terms, Privacy Policy, refund or cancellation policy and other terms disclosed before purchase, form the agreement governing the relevant offering.
Where a specific signed agreement applies to a program or service and conflicts with these general Terms, the specific agreement will prevail to the extent of that inconsistency.
